By downloading or using the Glam AI ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the App.

‍2. ELIGIBILITY
Users must be at least 4 years old to use the App. By using the App, you represent that you meet this age requirement.

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last Updated" date. Continued use of the App constitutes acceptance of the revised Terms.

  • Account Security: You are responsible for maintaining the confidentiality of your login information and for all activities conducted through your account.

5. USER CONDUCT
You agree not to:

  • Upload or transmit harmful, offensive, or unauthorized content.
  • Use the App for unauthorized or commercial purposes.

6. INTELLECTUAL PROPERTY
All content in the App, including text, graphics, logos, and software, is the property of Glam AI or its content suppliers and is protected by intellectual property laws. Use of such content is permitted solely for personal, non-commercial purposes.

License:
By uploading content to the App, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, distribute, create derivative works of, publicly display, and perform such content solely for the purposes of operating, improving, and promoting the App.

Responsibility:
You are solely responsible for any content you upload. By uploading content, you represent and warrant that:

  1. You own or have secured all necessary rights to the content.
  2. Your content does not violate any intellectual property, privacy, or other rights of any third party.
  3. The content complies with these Terms and applicable laws.

DMCA Compliance:
If you believe that your copyrighted work is being used without authorization within the App, you may submit a copyright infringement notice in accordance with our DMCA procedure. We will remove or disable access to the infringing material as required by law.

‍8. SAFE HARBOR FOR THIRD-PARTY CONTENT
Glamify acts as a platform for user-generated content and does not actively curate or monitor uploaded content. As such, Glamify is not liable for any infringing or harmful content uploaded by users, provided it complies with applicable safe-harbor laws. Glamify will remove infringing content upon receipt of a valid takedown notice.

‍9. PURCHASES AND PAYMENTS

  • Subscriptions: Certain features may require a subscription.
  • Cancellation: Subscriptions can be canceled according to the terms provided at the point of purchase.

10. DISCLAIMERS

  • No Professional Advice: The App provides beauty and makeup suggestions for informational purposes only and does not constitute professional advice.
  • "AS IS" Basis: The App is provided on an "as is" and "as available" basis without warranties of any kind.

11. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Glam AI is not liable for any indirect, incidental, or consequential damages arising from your use of the App or reliance on its content.

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your use of the App or violation of these Terms.13. DATA POLICY
By downloading and using the App, you consent to Glamify collecting, storing, and processing your data as necessary for the App's functionality and user experience.

  • Face Data Collection and Use:
  • We collect and store images of your bare face and the makeup look you wish to recreate. The bare face image is processed to apply the desired makeup look onto your face. The makeup look image is analyzed to identify the makeup style, which helps us provide you with suitable products, steps, and tips to recreate that look.
  • Data Sharing:
  • We may share your face data with trusted third-party services solely for processing purposes.
  • Data Storage and Retention:
  • Your face data is stored securely and retained as long as necessary for App functionality. You may request deletion of your face data by contacting us at contact.glamifyapp@gmail.com.
  • Data Security:
  • We are committed to protecting your personal information and implement industry-standard security measures to safeguard your data.

14. USER-GENERATED CONTENT REMOVAL
Glam AI reserves the right to remove, modify, or restrict access to any content uploaded by users that:

  • Violates these Terms.
  • Is subject to valid takedown requests.
  • Is deemed inappropriate, harmful, or in violation of applicable laws.

15. TERMINATION
We reserve the right to suspend or terminate your access to the App at our discretion, without notice, for any violation of these Terms or for other lawful reasons.
